EU puts off disputed software patent decision

BRUSSELS, Feb 11 (Reuters) - The European Union has delayed
plans to approve disputed rules on patenting computer
inventions, the EU executive Commission said on Friday, in a
setback to legislation seen as vital by big software companies.
EU ministers were expected to endorse the bill without
debate next Thursday and send it for a second reading in the
European Parliament, but the bloc's current president Luxembourg
has taken the issue off the meeting's agenda.
"The Commission regrets very much that the software patent
will not be on the agenda. It has been removed," Commission
spokesman Olivier Drewes told a news conference.

Ik zag nog geen expliciete opvolging van dit belangrijke bericht ?

Zeer relevant lijkt me de passage:

Eindelijk wordt de zeepbel doorprikt dat de software patenten nodig
zouden zijn om die arme, kleine software firma's te beschermen tegen 
die gevaarlijke, grote spelers in de markt ... Dat zie je nu ook
doordruppelen in afgeleide berichten hiervan.

Kleine firma's weten maar al te goed hoe ze vanuit hun sterke kanten
van flexibiliteit, creativiteit en vaak ook de gedrevenheid van enkele 
founders, in een niche sterk kunnen staan. Daar zijn juist de SW
patenten het wapen voor de grote industrie om die kleintjes nadien
"tot de orde" te roepen en ze te verplichten om zich goedkoop te
verkopen ofwel een eindeloze juridische strijd aan te gaan. Zonder
SW patenten zal die strijd in de markt gebeuren, waar veel meer
de innovatie beloond wordt, wordt dan in de rechtbank.
